That's right. We can no longer call ourselves an apothecary. Due to a 100+ year old law in Ohio, no business can use that word even in their advertising and definitely not in their name unless you're a licensed pharmacist. The amount of hoops we're being forced to jump through to stay in business is bordering on ridiculous. We must stop our production and build a food safety licensed facility that's 100-feet away from our residence, which complies with over a dozen different Ohio departments.
As soon as we thought we had a handle on the scope of this huge project, our business name comes into question. An apothecary is a historic name for an herbalist's shop, yet in Ohio unlike most other states, that name is barred from business owners who wish to do anything but sell pharmaceuticals. We had no idea this was the case, so we reached out to a handful of businesses around Ohio who use the word in their business name, or who have been threatened by the Ohio Pharmacy Board with a cease and desist letter. This warning letter apparently threatened their business, claiming they will receive legal action and substantial penalty fees if they do not change their name. These fees compounded daily as they tried to seek legal defense to overturn this, but they have failed and were forced to choose a play on words (i.e. Apotheosis, ApothaCare, etc.).
While we haven't been threatened as of yet, we are working hard to fix this ridiculous discrepancy before the ugly head of legal action turns its sights in our direction. The truth of our world and country is that we are indeed not free, because if we were, this would be a no brainer, and so would many of the ridiculous hoops we must jump through to continue to serve our community as Herbalists. In our current world we could figure this out, but only if we were rich people who knew the right people. Instead, we must cut our losses and try our best to keep doing what we love.
We've decided to keep fighting, but to be real with you all, this fight feels like we're banging our heads against brick walls at every turn. From building inspectors to a slew of state departments, it feels like everything is against us. Not only will this project cost twice as much as we ever dreamed, we may go through with all the changes needed, build a building, get it up to code, and still fail. For now, we're still up on two feet and fighting to keep going. Your patronage and your stories of success give us hope and fulfill our lives and we've agreed that if we quit we will regret it forevermore. So we keep fighting one day at a time.
